Criminal Law: Am I eligible for an expungement?

An eligibility for an expungement is a highly technical area that is very specific to the situation. In general, a person who may have a criminal offense expunged if ten (10) years has passed since the completion of his or her sentence. If you have a disorderly persons offense, it may be expunged after five (5) years. Certain Municipal Ordinance offenses may be expunged after two (2) years.


Generally, if arrested, but if it doesn't result in a conviction, it may be expunged without any additional delay. Please be mindful that there are limits as to the number of cases that may be expunged. Additionally, certain offenses that may not be expunged.
